4. Interruption de service
En cas d’interruption de plus de 2 jours consécutifs du service suite à un problème technique indépendant de notre volonté (problème direct sur le réseau de notre fournisseur, problème électrique), le remboursement de l’abonnement en cours sera effectué au prorata du temps d’indisponibilité du serveur. Aucune autre indemnisation de quelque nature que ce soit ne sera possible. Dans tous les autres cas, si azurhosts.com le désire, un geste exceptionnel à titre commercial pourra être discuté entre azurhosts.com et le client. Généralement nous avons un SLA de 99% sur l'ensemble de notre Infrastructure. Tous les gestes commerciales se réalisent en crédits et jamais en remboursement d'autres méthodes.
5. Réserves et rupture de l'abonnement
- Un pré-avis de 15 jours est nécessaire par le client, en effectuant une demande d'annulation au moins 15 jours avant la prochaine date d'échéance depuis son espace client afin de mettre fin au prélèvement pour le ou les service(s) souscrit(s). Cependant, la plus part de nos services peuvent recevoir une annulation de la part du client jusqu'à 24h avant la date d'échéance. Le client peut tout à fait faire sa demande en dessous de ces 24h, mais cela doit être fait avant 9h du matin (heure de prélèvement de l'ensemble des clients sous échéances) mais le système peut à tout moment faire ses actions journalières avant 9h.
- Le site azurhosts.com se réserve à tout moment le droit de modifier ou de changer la tarification de la prestation. Le client pourra accepter le changement ou le refuser et résilier son abonnement. Le client n’a aucune obligation sur la reconduction de l’abonnement et peut à tout moment résilier sa location ou décider de ne pas renouveler celui-ci. azurhosts.com se réserve le droit de fermer sans préavis le service et de résilier l’abonnement du client sans remboursement possible de celui-ci si une infraction est constatée par azurhosts.com par exemple, utiliser le service dans un but représentant toutes infractions punies par les lois françaises ou internationales. Les demandes d'abus sont traitées rapidement, et les suspensions de service d'aussitôt. Nous ne parlons cependant que de suspensions et jamais de suppressions : le client à 7 jours à compter de la suspension pour venir nous voir par ticket Discord, par mail ou par téléphone afin de discuter de ce dossier. Nous nous réservons cependant le droit de le supprimer après 7 jours sans retour de sa part. Dans tous les cas, aucun remboursement au prorata ne s'effectuera s'il vient entre ces 7 jours.
6. Droit de rétractation
- Conformément aux dispositions de l'article L.221-28 alinéa 13 du code de la consommation, le droit de rétractation ne peut être exercé pour les contrats de fourniture d'un contenu numérique non fourni sur un support matériel dont l'exécution a commencé après accord préalable exprès du consommateur et renoncement exprès à son droit de rétractation.
- Cas exceptionnelle(s) : La mention "Satisfait ou remboursé" qui indiqué qu'un remboursement est possible si le client n'est pas satisfait. La petite étoile " \* ", indique le délai pendant lequel le remboursement est possible si le client n'est pas satisfait. Le cas échéant sous 24h00.
- Je reconnais que l'équipe AzurHOSTS procédera à l'exécution immédiate de la prestation à compter de la validation de ma commande et à ce titre je renonce expressément à exercer mon droit de rétractation conformément aux dispositions de l'article L.221-28 du code de la consommation.
- Pour toutes demandes d'annulation d'un service, le service en question sera suspendu automatiquement suite à cette demande. Le reste de l'abonnement sera remboursé en crédits au prorata sur l'espace client.
7. Validité de la signature électronique
Tout bon de commande signé du client par "clic" constitue une acceptation irrévocable qui ne peut être remise en cause que dans les cas limitativement prévus dans les présentes conditions générales de vente tel que "droit de rétractation" et ceux en vigueur dans le droit de la consommation. Le "clic" associé à la procédure d'authentification, de non-répudiation et de protection de l'intégrité des messages constitue une signature électronique. Cette signature électronique a valeur de signature manuscrite entre les parties.
8. Autorisation et utilisation de la collecte des données
Le site azurhosts.com s’efforce de protéger la vie privée de ses utilisateurs en respectant la réglementation en vigueur à cet égard. azurhosts.com s’engage à ne jamais divulguer vos informations à des tiers pour raisons commerciales ou à des fins statistiques.
9. Obligations de l'Utilisateur
Il est interdit à l'Utilisateur de diffuser les contenus suivants, sans que cette liste soit limitative :
- Des documents, informations, propos ou contenus contraires au droit pénal, diffamatoires, obscènes, violents, menaçants, incitant à la haine, la violence ou la discrimination ou à des actes relevant du droit pénal, racistes, pornographiques ou similaires, portant atteinte au droit à la protection de la vie privée ou susceptibles de par leur nature de porter atteinte au respect de la personne humaine et à sa dignité, à l'égalité entre les hommes et les femmes, à la protection des enfants et des adolescents. Des contenus utilisant sans autorisation des données appartenant à des tiers et protégées au regard du droit d'auteur, du droit des marques ou du droit de la concurrence.
Il est également interdit à l'Utilisateur, sans que cette liste soit limitative :
- De transmettre sur le réseau des fichiers contenant un virus ou des données altérées. D'effacer toute mention de droits d'auteurs ou de désignation de propriété. D'utiliser le site d'une manière qui gêne l'accès d'autres Utilisateurs audit site. De transmettre des informations ou documents à des fins publicitaires ou de piratage quels qu'ils soient.
- De fichiers musicaux ou vidéos non libres de droits encodés sous le format MP3, DIVX ou autre. D'effectuer des actions qui ont pour simple but de rendre nos services instables ou à des fins nocives.
- D'exploiter de façon détournée des fonctions de nos services non prévues à cet effet. D'utiliser nos services afin de participer à la creation monétaire ou plus communément appelée "minage", de crypto-monnaie ou monnaie cryptographique (bitcoin, litecoin, dogecoin, etc...). Il s'engage également à ne pas inclure sur son site de liens hypertextes et à ne pas faire de redirection de son domaine vers des sites diffusant ce type de service.
Sous peine de suspension définitive sans aucun remboursement, l'utilisateur ne doit pas effectuer ce qui suit :
- Attaques DDoS sortantes. Scan de ports réseaux tous protocoles (TCP/UDP/ICMP). Spam e-mail. De diffamer publiquement l'entreprise, les gérants ou les employés. Que la plateforme publique soit virtuelle ou réelle la sanction restera la même. Ainsi que toutes autres actions interdites par les lois informatiques.
- Si l'hébergeur a un doute sur la véracité de ces informations, une suspension de service temporaire pourra avoir lieu ainsi qu'une vérification d'identité grâce à un justificatif de domicile et une pièce d'identité.
- Le client est libre de refuser cela, mais l'hébergeur peut de tout droit décider de suspendre son service, et ce, sans remboursement.
- Le client doit accepter le faite que le support puisse montrer publiquement les demandes créées en billet et/ou preuves qui démontrent vos actions interdites. A partir du moment où ces règles sont enfreintes, vous pouvez être banni définitivement de notre réseau. Aucun retour arrière ou demande ne pourra être effectuée après vérification DEFINITIVE d'un agent. Tout contournement pourra amener à une poursuite judiciaire.
10. Augmentation tarifaire
- La société AzurHOSTS se réserve le droit de modifier ses tarifs à n'importe quel moment, et ce, sans pré-avis.
- La modification tarifaire prendra effet lors de la prochaine échéance du client (utilisateur). Celui-ci est libre d'accepter ou refuser.
- Un refus de la part du client conduira à l'annulation immédiate du service lors de l'échéance de celui-ci
